By accessing or using Kwery ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Kwery provides an API service that offers:

  • Historical order book data from Polymarket and Kalshi prediction markets
  • Hyperliquid perpetuals and spot market data
  • Sub-second resolution snapshots of BTC Up/Down markets
  • Bid/ask depth, prices, and reference prices sourced from Binance spot and futures feeds and Chainlink oracle data
  • API key management for authenticated access

The Service is provided for research, backtesting, and analytical purposes only.

3. Account Registration

To access the Service, you must:

  • Create an account with a valid email address
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials and API keys
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. API Usage

4.1 API Keys

API keys are provided for your personal or authorized business use only. You may not:

  • Share, sell, or transfer your API keys to third parties
  • Use API keys for unauthorized commercial purposes
  • Attempt to circumvent rate limits or access restrictions

4.2 Rate Limits

The Service may impose rate limits on API requests. Excessive requests that disrupt service availability may result in temporary or permanent suspension of access.

4.3 Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Engage in market manipulation or fraudulent activities
  • Interfere with or disrupt the Service's infrastructure
  • Reverse engineer or attempt to extract source code
  • Resell or redistribute the data without authorization

5. Data and Accuracy

While we strive to provide accurate historical data:

  • Data is provided "as-is" without warranties of accuracy or completeness
  • Historical data may contain gaps or inconsistencies
  • We do not guarantee real-time data availability
  • Data should not be used as the sole basis for trading decisions

6. Intellectual Property

The Service, including its design, code, and documentation, is protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service as intended.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KWERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR TRADING LOSSES.

9. Indemnification

You agree to indemnify and hold harmless Kwery from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms.

11. Modifications

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Independent Service

Kwery is an independent service and is not affiliated with, endorsed by, or connected to Polymarket, Kalshi, Hyperliquid, Binance, Chainlink, or any other exchange, oracle, or prediction market platform.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
